The Clearinghouse-II rule, which took effect November 18, 2024, completed the transition by removing the parallel checks employers used to perform with state driver licensing agencies. The result: a single source of truth for CDL drug-and-alcohol violation history.

What stayed the same

Pre-employment full query — required before hiring any CDL driver, with the driver’s electronic consent.

Annual limited query — every employer must run a limited query on every current CDL driver at least once per year.

Mandatory reporting — employers must report drug-and-alcohol violations and return-to-duty determinations within 3 business days.

What changed

State driver licensing agencies (SDLAs) now act on Clearinghouse data directly. When a driver has a “prohibited” status in the Clearinghouse, their CDL or CLP is downgraded to a non-commercial license — automatically, without a separate notice from FMCSA. Employers no longer need to run separate state-by-state DAC checks for D&A history; the Clearinghouse is the single source.

This also means a driver in a “prohibited” state cannot be hired to drive a CMV in any state, period — until they complete the return-to-duty process with a Substance Abuse Professional (SAP) and pass a return-to-duty test.

What this means for small carriers

If you’ve been treating the Clearinghouse as a paperwork formality, the consequences of skipping a query just got sharper. A driver hired without a clean Clearinghouse query who turns out to be in “prohibited” status exposes your operation to FMCSA enforcement plus the practical reality that the driver’s CDL may be downgraded mid-trip.

Owner-operators without W-2 employees still need a consortium / TPA enrollment plus annual self-queries. The rule applies equally.

Our consortium service handles enrollments, random selections, MRO review, and Clearinghouse query support.
