Seguros y trámites federales

MCS-90, BMC-91, BMC-34 — radicados y monitoreados.

What are federal insurance filings?

Federal insurance filings prove to FMCSA that you carry the minimum financial responsibility required to operate. They’re separate from your insurance policy itself — the filings are forms your insurer sends to FMCSA on your behalf certifying that you’re covered. The rules live in 49 CFR Part 387.

The forms most carriers encounter:

  • Form MCS-90 — endorsement attached to your primary liability policy guaranteeing the federally required minimums regardless of policy exclusions.
  • BMC-91 / BMC-91X — proof of public liability filing. The “X” form is for split coverage across two insurers.
  • BMC-34 — proof of cargo liability filing (required for household-goods carriers; market-required for general freight).
  • BMC-84 / BMC-85 — broker financial-responsibility bond ($75,000) required for property brokers and freight forwarders.

If your insurance lapses, FMCSA receives an automatic cancellation notice and your operating authority can be revoked within 30 days. We coordinate the filings with your insurer, monitor the FMCSA records weekly, and intervene before any cancellation reaches the revocation window.

Who needs this

  • Every for-hire motor carrier with active MC operating authority.
  • Brokers and freight forwarders (BMC-84 surety bond or BMC-85 trust fund).
  • Any carrier whose insurance is changing, expiring, or being replaced.
  • Any carrier that has received a notice of cancellation from FMCSA.

Nuestro proceso

  1. Coverage review

We confirm your liability minimums match cargo type — $750K general, $1M/$5M hazmat per § 387.9.

  2. Coordinate with insurer

We send your underwriter the FMCSA filing instructions and confirm submission.

  3. Verify in FMCSA records

We confirm the MCS-90, BMC-91X, or BMC-34 appears on your active filings.

  4. Continuous monitoring

Weekly checks for cancellation notices; same-day intervention if one appears.

  5. Renewal coordination

At each policy renewal we confirm new filings replace the old ones cleanly.

Preguntas frecuentes

$750,000 combined single limit per 49 CFR § 387.9 for non-hazardous freight. Most market-rate policies start at $1M because shippers and brokers commonly require it.
Federally required only for household-goods carriers ($5,000 per truck per shipment minimum). Most general-freight carriers carry $100,000 because shippers and brokers require it contractually.
Both prove public liability coverage. The “X” version is used when you have split coverage from two different insurers — common with primary plus excess layers.
The new filing must be on file before the old one cancels — typically a 30-day window. We coordinate with both carriers to ensure no gap.
FMCSA receives automatic cancellation notice from the insurer. You have 30 days to file replacement coverage before operating authority is revoked. We monitor and intervene before that.
No. A COI is a private document for shippers or brokers. Federal filings (MCS-90, BMC-91X, BMC-34) are filed with FMCSA and visible in the public Licensing & Insurance database.
